1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of websites, apps, and services offered by HakoCut ("HakoCut," "we," "us," or "our") at hakocut.com (the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the service

HakoCut is an AI-assisted video editing product that lets you create, edit, enhance, and publish video content. Features may include local and cloud editing, generative tools, captions, templates, project sync when signed in, and optional integrations with third-party platforms such as YouTube.

We may add, change, or discontinue features. Some features may require an account, a paid plan, API keys you provide (BYOK), or connection to third-party services.

3. Accounts

You may use parts of HakoCut without an account. If you create or use an account (including Google or Apple sign-in), you must provide accurate information, keep credentials secure, and notify us of unauthorized use. You are responsible for activity under your account.

4. User responsibilities

You agree that you will not:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Upload, generate, or publish content that infringes others' rights or violates applicable law
  • Attempt to disrupt, reverse engineer (except where allowed by law), or abuse the Service or related APIs
  • Misuse YouTube or other third-party APIs, including scraping or quota abuse beyond authorized use
  • Impersonate others or misrepresent your affiliation with HakoCut

You are solely responsible for the content you create, import, or publish using HakoCut, including compliance with platform rules where you distribute that content.

5. YouTube API Services and other third-party APIs

HakoCut may integrate with YouTube API Services and other third-party APIs to provide optional features (for example channel connection, insights, metadata tools, or publish workflows).

Your use of YouTube features in HakoCut is subject to the YouTube Terms of Service. Google's data practices are described in the Google Privacy Policy. Additional details about how we handle YouTube-related data are in our Privacy Policy.

Third-party services are not controlled by HakoCut. Their availability, terms, and pricing may change. You are responsible for complying with those third-party terms and for any keys or credentials you supply.

6. Intellectual property

Your content. You retain ownership of content you create or upload. You grant HakoCut a limited license to host, process, and display that content solely as needed to operate the Service features you use (for example sync, export, or AI tools you invoke).

HakoCut IP. HakoCut, its branding, software, and documentation remain owned by HakoCut and its licensors. Open-source components are licensed under their respective licenses. Except as permitted by those licenses or these Terms, you may not copy or redistribute our proprietary materials.

7. AI and generative features

Optional AI features may run on-device or via providers you or we configure. Outputs can be inaccurate or unexpected. You are responsible for reviewing outputs before publishing. Do not rely on AI features as a sole source of factual or legal advice.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that content will never be lost. Local browser storage can be cleared by you or your device; export important work.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAKOCUT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO HAKOCUT FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID ANY AMOUNTS.

10. Indemnification

You agree to indemnify and hold harmless HakoCut and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or third-party terms (including YouTube's).

11. Termination

You may stop using HakoCut at any time and may delete your account where that option is offered. We may suspend or terminate access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Provisions that by their nature should survive (including IP, disclaimers, limitation of liability, and indemnity) will survive termination.

12. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Material changes may be communicated through the Service or by email when appropriate. Continued use after changes become effective constitutes acceptance.

13. Governing law

These Terms are governed by applicable law in the jurisdiction where HakoCut operates its primary business, without regard to conflict of law principles, except where mandatory consumer protections in your country apply. Courts in that jurisdiction will have exclusive venue, subject to those mandatory protections.
